These Terms of Service ("Terms") govern your use of blackoptixtintwilmington.com and the services offered by QBSI Holdings LLC ("we," "us," or "our").

By using our website, submitting a form, requesting a quote, booking an appointment, or opting into our messaging, you agree to these Terms. If you do not agree, do not use the Services.

01 Acceptance of terms

By accessing or using the Services, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

02 Eligibility

You must be at least 18 years old (or the age of majority in your state) to use the Services and to consent to our messaging programs. The Services are not directed to children.

03 Our services

QBSI Holdings LLC provides services and related products as described on our website. We offer the ability to request quotes, book appointments, and communicate with us. Specific services, availability, and pricing may change at any time.

04 Quotes, estimates, and appointments

Quotes and estimates provided through the website or by message are for informational purposes, are not guaranteed, and may be subject to inspection, availability, and final confirmation. Booking a requested appointment time is subject to our confirmation. Payment is handled in person at the time of service unless otherwise agreed.

Cancellations and no-shows. We ask that you give us reasonable advance notice if you need to cancel or reschedule an appointment. We may decline to rebook or may apply a fee for repeated missed appointments, as communicated to you at the time of booking.

Promotions and offers. Any promotions, discounts, or special offers we advertise are subject to their stated terms and any conditions we disclose (such as eligibility, expiration dates, and limits). Offers may not be combined unless we say so, may be changed or withdrawn at any time, and are never conditioned on agreeing to receive marketing messages.

05 Text messaging (SMS) program terms

By providing your mobile number or opting in, you agree to these messaging terms.

  • Program description. QBSI Holdings LLC sends (a) transactional messages about your appointments, quotes, and service updates, and (b) — only if you separately opt in — marketing messages such as promotions, offers, and discounts.
  • Consent. You may opt in through our website, by texting us first (including texting a keyword to our number), by phone, or in person. Providing your number for a quote or appointment constitutes consent to transactional messages. Marketing messages require a separate, optional opt-in and are never a condition of any purchase.
  • Message frequency. Frequency varies depending on your interactions with us and, if opted in, ongoing promotions. Messages may be sent using automated technology.
  • Costs. Message and data rates may apply, depending on your mobile plan and carrier.
  • Opt out. Reply STOP to any message to unsubscribe. You may continue to receive transactional messages about a service you have actively requested.

  • Carriers. Carriers are not liable for delayed or undelivered messages. Supported carriers may change without notice.
  • Eligibility. You represent that you are the account holder or authorized user of the mobile number you provide.

06 Electronic communications, call recording, and automated/AI interactions

By using the Services, you consent to receive communications from us electronically (by text or email, consistent with your consent choices), and you agree that electronic communications satisfy any legal requirement that communications be in writing.

We may record or monitor phone calls with you for quality, training, and recordkeeping purposes. Where the law requires notice or consent, we will inform you at the start of the call, and by continuing the call you consent to the recording.

Some communications — including text messages and any chat feature on our website — may be handled by automated systems, by artificial intelligence (which may use third-party providers to process your messages), by our staff, or by a combination of these, and a single conversation may move between them. Automated and AI-generated responses may not always be accurate, do not constitute professional advice, and should not be relied upon as such. Any price, quote, estimate, availability, or appointment time provided by an automated or AI system is not a binding offer and is subject to our confirmation. 07 Acceptable use

08 Intellectual property

All content on our website — including text, graphics, logos, and images — is owned by QBSI Holdings LLC or its licensors and is protected by intellectual property laws. You may not copy, reproduce, or use it without our permission.

10 Disclaimers

The Services and website are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the website will be uninterrupted, error-free, or secure. Any separate written warranty we provide for specific products or services is governed by that warranty's own terms.

11 Limitation of liability

To the fullest extent permitted by law, QBSI Holdings LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues, arising out of or related to your use of the Services. Our total liability for any claim relating to the Services will not exceed the amount you paid us, if any, for the service giving rise to the claim.

12 Indemnification

You agree to indemnify and hold harmless QBSI Holdings LLC and its owners, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising out of your misuse of the Services or violation of these Terms.

13 Dispute resolution — binding arbitration and class-action waiver

Please read this section carefully — it affects your legal rights.

Any dispute or claim arising out of or relating to these Terms, the Services, or any messages you receive from us (including claims under the Telephone Consumer Protection Act) will be resolved by binding individual arbitration, rather than in court, except that either party may bring a qualifying claim in small-claims court.

Class-action waiver. You and QBSI Holdings LLC agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate more than one person's claims or preside over any form of class proceeding.

Process. Arbitration will be administered by a recognized arbitration provider under its consumer rules, and will take place in New Hanover County, North Carolina, or via remote/written proceedings where available. The arbitrator's decision is final and binding.

Right to opt out of arbitration. You may opt out of this arbitration agreement by sending written notice to info@blackoptixtintwilmington.com within 30 days of first accepting these Terms, stating your name and that you opt out of arbitration. Opting out will not affect any other part of these Terms.

If this arbitration agreement is found unenforceable, the class-action waiver will remain in effect to the extent permitted by law.

14 Governing law and venue

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws rules. Subject to Section 13, any action not subject to arbitration will be brought exclusively in the state or federal courts located in New Hanover County, North Carolina.

15 Changes to these Terms

We may update these Terms from time to time. The updated version will be posted with a new effective date, and your continued use of the Services after changes take effect constitutes acceptance.

16 Severability and entire agreement

If any provision of these Terms is held invalid, the remaining provisions will remain in full effect. These Terms and our Privacy Policy are the entire agreement between you and QBSI Holdings LLC regarding the Services.
