01 Who we are

02 Information we collect

Information you provide to us. When you fill out a form, request a quote, book an appointment, or contact us, we may collect:

• Your name
• Your mobile phone number
• Your email address
• Vehicle information (such as make, model, and year)
• The service or package you select or inquire about
• Any other information you choose to provide in messages or notes

Information from phone calls. If you call us or we call you, we may record or monitor the call for quality, training, and recordkeeping purposes. Where required by law, we will notify you at the start of the call, and by continuing the call you consent to the recording.

Information collected automatically. When you visit our website, we and our service providers may automatically collect:

• Device and browser type, operating system, and language
• IP address and general location (city/region level)
• Pages viewed, links clicked, time on site, and referring URLs
• Information collected through cookies and similar technologies (see Section 5)

We do not collect payment card information through our website; payments are handled in person.

03 How we use your information

We use the information we collect to:

• Respond to your quote requests, inquiries, and appointment bookings
• Send you transactional text messages and emails about your appointments, quotes, and services (see Section 4)
• Send you marketing messages if you have opted in (see Section 4)
• Operate, maintain, and improve our website and Services
• Measure and improve our advertising and marketing (see Section 6)
• Comply with legal obligations and protect our rights

04 Text messaging (SMS) and your consent

We offer text messaging, and you may opt in through several channels: by submitting a form on our website, by texting us first (including texting a keyword to our number), by phone, or in person at our location. In each case we provide the required disclosures at the point of opt-in.

Transactional messages. When you provide your phone number to book an appointment or request a quote, you consent to receive text messages from us about that appointment, quote, and related service updates.

Marketing messages. We send promotional texts (offers, discounts, and updates) only to people who separately and voluntarily opt in by checking the marketing consent box. Marketing consent is never a condition of purchasing any product or service.

For all messages: messages may be sent using automated technology, message frequency varies, and message and data rates may apply. Reply STOP to opt out at any time, or HELP for help. Opting out of marketing messages will not stop transactional messages related to a service you have requested.

We do not sell, rent, or share your mobile phone number or SMS opt-in consent with third parties or affiliates for their own marketing purposes. Your text-messaging consent will not be shared with any third parties except subcontractors or service providers (such as our messaging platform) acting on our behalf to deliver the messaging service, and those parties are contractually prohibited from using the information for any other purpose.

Automated, AI-assisted, and staff communications. Our communications — including text messages and any chat feature on our website — may be handled by automated systems, by artificial intelligence tools (including tools provided by third-party service providers), by our staff, or by a combination of these, and a single conversation may move between them. When you message us or use our chat feature, your messages may be processed and stored by us and those providers to operate the service, respond to you, and improve our support. By using these features, you consent to this processing. Automated and AI systems may not always be accurate; see our Terms of Service for details on automated responses.

05 Cookies and tracking technologies

We use cookies, pixels, tags, and similar technologies to operate the website, remember your preferences, understand how the site is used, and support advertising. You can usually control cookies through your browser settings; disabling some cookies may affect how the site works.

06 Analytics and advertising

We work with analytics and advertising providers — including social media and search platforms such as Meta, Google, TikTok, and LinkedIn — that use cookies, pixels, tags, and similar technologies (including server-side connections) to help us measure website activity, understand how our Services are used, and deliver and measure advertising. These providers may collect information about your activity on our website over time and across other websites and services, and may combine it with information they already hold.

We may use other or additional providers from time to time.

These activities may constitute "sharing" or processing of your information for targeted advertising as defined under certain state privacy laws. See Section 11 for how to opt out. You can also opt out of many interest-based ads through the Digital Advertising Alliance (optout.aboutads.info) and the Network Advertising Initiative (optout.networkadvertising.org), and through the settings offered by the advertising and social-media platforms you use.

07 How we share information

We do not sell your personal information for money. We may share information:

• With service providers who perform services for us (such as our CRM and messaging platform, email provider, website host, and analytics/advertising partners), under contracts limiting their use of the information.
• For legal reasons, if required by law or to protect the rights, safety, or property of QBSI Holdings LLC, our customers, or others.
• In a business transfer, such as a merger, acquisition, or sale of assets.

As stated in Section 4, SMS opt-in data is never shared for third-party or affiliate marketing.

08 Email communications

If you receive marketing emails from us, you can unsubscribe at any time using the link in any email. We will honor opt-out requests promptly. Transactional emails about your appointments or services may continue.

09 Data retention

We keep personal information for as long as needed to provide the Services, comply with our legal obligations, resolve disputes, and enforce our agreements. We retain records of messaging consent for at least the period required to demonstrate compliance.

10 Data security

We use reasonable administrative, technical, and physical safeguards to protect your information. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.

11 Your privacy rights

Depending on where you live, you may have rights under laws such as the California Consumer Privacy Act (CCPA/CPRA), the Virginia Consumer Data Protection Act (VCDPA), and other state privacy laws. These may include the right to:

• Know or access the personal information we hold about you
• Correct inaccurate information
• Delete your information
• Obtain a portable copy of your information
• Opt out of targeted advertising and of any "sale" or "sharing" of your information

Do Not Sell or Share / Opt out of targeted advertising. To opt out of the advertising-related sharing described in Section 6, contact us at info@blackoptixtintwilmington.com and we will honor your request, and you can use the browser and ad-industry opt-out tools listed in Section 6. Where required by applicable law, we also honor recognized browser-based opt-out preference signals (such as the Global Privacy Control) to the extent our systems support them.

No financial incentives. We do not offer financial incentives or charge different prices in exchange for the collection, retention, sale, or sharing of your personal information. Any promotions or discounts we advertise are available on their stated terms and are not conditioned on your agreeing to receive marketing messages.

You may also have the right to appeal a decision or to lodge a complaint with your state attorney general. We will not discriminate against you for exercising your rights.

12 Children's privacy

Our Services are intended for adults 18 and older and are not directed to children. We do not knowingly collect personal information from children under 13, and our messaging programs are not directed to anyone under 18. If you believe a child has provided us information, contact us and we will delete it.

13 Third-party links

Our website may link to third-party sites we do not control. This Policy does not apply to those sites, and we are not responsible for their privacy practices.

14 Changes to this Policy

We may update this Policy from time to time. We will post the updated version with a new effective date, and material changes will be communicated as required by law.
